Federal Judge Mandates Release of Abrego Garcia from ICE Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.
In her decision, the judge noted that the authorities lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
